What happened
President Donald Trump filed an emergency appeal Thursday asking the Supreme Court to remove Lisa Cook from the Federal Reserve Board. The filing comes one day after the Fed cut interest rates for the first time in months. Trump has repeatedly demanded lower rates.
If the court sides with Trump, it would be the first time in the Federal Reserve’s 111-year history that a president removed a sitting governor.
Why Cook was targeted
The administration claims Cook committed mortgage fraud by listing two homes as primary residences to get better loan terms. Sometimes, she declared one as a vacation property. Trump fired Cook on August 25, but lower courts blocked the dismissal. Judges said she had not received due process.
The administration stated:
“The president may reasonably determine that interest rates paid by the American people should not be set by a governor who appears to have lied about facts material to the interest rates she secured for herself.”
Cook’s response
Cook’s attorneys warned that firing her could destabilize the economy and disrupt financial markets.
“Removing her would threaten economic stability and raise questions about the Federal Reserve’s independence—risking shock waves in financial markets,” her legal team wrote.
The legal fight
- On September 10, U.S. District Judge Jia Cobb blocked the dismissal. She said the administration did not show that Cook harmed the public interest.
- The D.C. Circuit Court refused to overturn that ruling. It noted Cook received no meaningful notice or chance to respond.
- Trump now seeks a temporary order from Chief Justice John Roberts to remove Cook while the Supreme Court considers the case.
Why it matters
The Supreme Court has treated the Federal Reserve as a “uniquely structured, quasi-private entity.” It remains shielded from daily presidential control. This case could test that protection and carry major consequences for Fed independence and market stability.
